HOT AUTO - represents the trade name of the legal entity HOT AUTO SRL with its registered office in Romania, Str. Durau 118, 8, 12916 Sector 1, Bucharest.
Seller – HOT AUTO SRL with its registered office in Romania, Str. Durau 118, 8M, 12916 Sector 1, Bucharest.

Customer – a natural person or any other legal entity that creates an account or places an order without creating an account on www.hotauto.eu
Potential customer – a natural person or legal entity who has or obtains access to the content, through any means of communication provided by HOT AUTO (via Email, WhatsApp, electronic, telephone, etc.) and which requires the creation and use of an Account.
User - natural person or legal entity registered on www.hotauto.eu who has given his consent regarding the site-specific clauses in the General Terms and Conditions section - by completing the account creation process.
Account - the dedicated section on www.hotauto.eu for the e-mail address and password that allows the Customer to place an order and which contains information about the Customer/ Potential Customers and the User history on www.hotauto.eu (orders, wishlist, fiscal invoices, guarantees, etc.).
Favorite products - section of the Account that allows the Customers / Users to create his list of favorite products - wishlist.
List of Favorite Products - the web page on www.hotauto.eu where the Customers / Users can add his/her favorite products and which, later, he/she can add to the shopping cart ("My cart").
Order - the electronic document that represents a form of communication between the Seller and the Customer, through which the Customer transmits to the Seller, through the Site - his intention to purchase the products from the Site.
Products - any product, including the documents mentioned in the Order, which are to be provided to the Customer by the Seller, as a result of the concluded Contract.
Campaign / Promotion - the action of displaying for commercial purposes, a number of Products existing in stock, for a limited period of time established by the Seller.
Contract - represents the distance contract concluded between the Seller and the Customer, without the simultaneous physical presence of the Seller and the Customer.
Content - all information on the site that can be visited, viewed, or otherwise accessed by using electronic equipment;
- the content of any e-mail sent to the Customers by the Seller by electronic means and/or any other available means of communication;
- any information communicated by any means by an employee/collaborator of the Seller to the Customer, according to the contact information;
- information related to the Products and/or Services and/or tariffs practiced by the Seller in a certain period;
- information related to the Products and/or Services and/or tariffs practiced by a third party with which the Seller has concluded partnership contracts, in a certain period;
- data regarding the Seller or other privileged data of the Seller.
Comment / Review - a written evaluation by the owner or beneficiary of a Product, written based on personal experience and his ability to make qualitative comments and express his own impressions, without necessarily representing the point of view of the Seller or manufacturer.
Newsletter - means of periodic information, exclusively electronic, respectively electronic mail (e-mail) and/or SMS, on the Products / or Promotions, carried out by the Seller during a certain period of time, without any commitment on the part of the Seller with reference to the information contained in it.
Transaction - the collection by HOT AUTO of an amount of money resulting from the sale of a Product or the reimbursement to the Customer of an amount, regardless of the delivery method.
Specifications - details and/or descriptions of the Products.
CONTRACTUAL DOCUMENTS
By making an Order on www.hotauto.eu, the Customer agrees with the form of communication (Phone, SMS, and Email) through which the Seller carries out its commercial operations.
The notification received by the Customer, after making the Order, has the role of information, clarification and does not represent the acceptance of the Order. This notification is made electronically (e-mail).
The Seller reserves the right to contact the Customer by phone or email to confirm the Order and to validate the products or to invalidate them, depending on the Customer's mentions or the Seller's stock availability.
The contract is considered concluded between the Seller and the Customer at the moment of the phone or written confirmation of the order, confirmation made by a member of the HOT AUTO team together with the Customer.
The document and the information provided by the Seller on the site will be the basis of the Contract, in addition to its being the invoice, a receipt issued by the Seller for the Products purchased.
Access, in order to place an Order, is allowed to any Potential Customers / Customers. In certain situations - for justified reasons – HOT AUTO reserves the right to restrict the access of the Customer in order to place an Order and/or to some of the accepted payment methods, if it considers that based on the former interaction with the Customer or by his/her activity or actions which could harm HOT AUTO in any way. In any of these cases, the Customer may contact the Customer Relations of HOT AUTO, in order to be informed about the reasons that led to the application of the previously mentioned measures.
The communication with the Seller can be made electronically through the addresses mentioned in the “Contact page” or any contact information sections of www.hotauto.eu and through the phone number provided in the respective section.
In case of an unusually high volume of traffic coming from an internet network, HOT AUTO reserves the right to ask the Potential Customers / Customers to manually enter the “captcha” validation codes, in order to protect the information within online store.
HOT AUTO is free to publish on www.hotauto.eu information about Products and/or promotions practiced by it or by any other third party with which HOT AUTO has concluded partnership, in a certain period of time and within the availability on stock.
All tariffs related to the Products presented on the online store of HOT AUTO are expressed in multicurrency (Euro, US Dollars, Forint, Koruna, Kuna, Lev, UK Pound Sterling, Swiss Franc, Zloty, etc.) and have expressly mentioned the phrases "Price without VAT", "Prices include VAT"
In the case of online payments, the Seller is not / cannot be held responsible for any other additional costs borne by the Customer, the responsibility for this action is borne only by the Customer.
All the information used for the description of the Products available on the Site (static, dynamic images, multimedia presentations, etc.) does not represent a contractual obligation on the part of the Seller, these being used exclusively as a default reference.
After 15 (fifteen) days from the purchase of a Product and/or Service, the Customer may be requested to register a Comment related to the purchased Product and/or Service. The request will be sent to the e-mail address registered by the Customer in the Account. In this way, the Customer contributes to informing other possible Users / Customers / Potential Customers on the online store.
The Seller may assign and/or subcontract a third party for Services related to the fulfillment of the Order and/or delivery of the Order, with the information of the Customer, without the consent of the Customer. The Seller will always be liable to the Customer for all contractual obligations.
INTELLECTUAL AND INDUSTRIAL PROPERTY LAW
The content - as described in "DEFINITIONS AND TERMS" - including but not limited to logos, stylized representations, commercial symbols - text and /or multimedia content presented on the online store, are the property of HOT AUTO.
The Potential Customers / Customers is not permitted to copy, distribute, publish, transfer to third parties, modify and/or alter the specific signs of copyright HOT AUTO, use, display or include any Content in any context other than that intended and made by HOT AUTO. The inclusion of any Content outside the site, the removal of the specific signs or Logos of the HOT AUTO copyright, as well as the participation in the transfer, sale, distribution of materials made by reproducing, modifying, or displaying the Content, except with the express wrote consent of HOT AUTO.
Any Content to which the Potential Customers / Customers has and/or obtains access by any means is subject to this text if the Content elements are not accompanied by a specific, express and valid use agreement concluded with HOT AUTO.
The Potential Customers / Customers shall not copy, transfer and/or use elements of the Content for personal, commercial, or non-commercial purposes.
In case HOT AUTO grants the Potential Customers / Customers the right to use in the form described in a separate use agreement, a certain content, to which the Potential Customer / Customer has or obtains access as a result of this agreement, that right will extend only to that or those contents defined in the agreement, only during its existence or these contents on the online store or the period defined in the agreement, according to the defined conditions and if HOT AUTO is not harmed in any way by this content, during or after the expiration of the user agreement.
No Content transmitted to the Potential Customer or Customer, by any means of communication (electronic, phone, etc.) or acquired by him by accessing, visiting and/or viewing does not represent a contractual obligation on the part of HOT AUTO.
Any use of the Content for purposes other than those expressly permitted by this Document or the accompanying use agreement, if any, is prohibited.
ONLINE ORDER
The Potential Customer / Customer can place an Order on the HOT AUTO online store, by adding the desired Products in the shopping cart, following to complete the Order by making the payment in one of the ways expressly indicated. Once added to the shopping cart, a Product(s) is available for purchase to the extent that there is stock available for it. Adding a Product to the shopping cart, in the absence of completing the Order, does not entail the registration of the order and implicitly also the automatic reservation of the respective Product(s).
By completing the Order, the Customer agrees that all data provided by him - necessary for the purchase and delivery processes - are correct, complete, and true at the date of placing the Order.
By completing the Order, the Customer agrees that the Seller may contact him, by any means convenient and available by the Seller, in any situation considered necessary by the Seller.
The Seller may cancel the Order made by the Customer, following a notification communicated by phone or in writing addressed to the Customer, without any subsequent obligation of any party to the other or without any party being able to claim damages from the other in the following cases:
a. non-acceptance by the issuing bank of the Customer's card, of the transaction, in case of online payment;
b. invalidation of the transaction by the card processor approved by HOT AUTO, in case of online payment;
c. the data provided by the Customer on the Site are incomplete and/or incorrect.
If the Customer requests the withdrawal from the Contract within the legal term of withdrawal, he must also return any gifts/bonuses that accompanied the respective product. If the Order is paid, the Seller will refund the amount within a maximum of 15 (fifteen) days from the date of informing the Seller by the Customer of his decision to withdraw from the Contract. The amount will be returned as follows:
a. For Orders paid by card online, by refund to the account from which the payment has been made;
b. for Orders paid with Paypal or Bank transfer, by Paypal or bank transfer;
The Seller will be able to defer the refund until receipt of the Products sold or until receipt of proof that they have been shipped if he has not offered to recover the Products himself (the most recent date will be taken).
If a Product ordered by the Customer cannot be delivered by the Seller, the Seller will inform the Customer of this fact and will return to the Customer's account the value of the Product, within a maximum of 10 (ten) days from the date on which the Seller became aware of this fact or from the date on which the Customer has expressly expressed its intention to terminate the Contract.
PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL IS NOT ENSURED
The following are exempted from the right of withdrawal from the Contract:
a. Service contracts, after the full provision of services, if the execution began with the prior express consent of the Customer and after he has confirmed that he has become aware that he will lose the right of withdrawal after the full execution of the Contract by the Seller;
b. the supply of Products which price depends on the fluctuations on the financial market which the Seller cannot control and which may take place during the withdrawal period;
c. the supply of Products that are custom made by HOT AUTO.
d. the supply of sealed Products which cannot be returned for reasons of health protection or hygiene and which have been unsealed by the Customer;
e. the supply of Products which after delivery are - according to their nature - inseparable in connection with other elements or partially or fully damaged.
The information of any nature provided by the Potential Customer / Customer to the Seller will remain the property of the Seller.
No public statement, promotion, press release, or any other form of disclosure to third parties will be made by the Potential Customer / Customer regarding the Order / Contract without the prior written consent of the Seller.
By transmitting information or materials through this site, you give the Seller unrestricted and irrevocable access to them, the right to use, reproduce, display, modify, transmit and distribute such materials or information. You also agree that the Seller may freely use, in its own interest, these ideas, concepts, know-how, or techniques that you have sent us through the site / Online store of HOT AUTO. If the legislation in force does not provide other specifications in this respect, HOT AUTO will not be subject to obligations regarding the confidentiality of the information sent.
By registering in the HOT AUTO database through the HOT AUTO website / online store, the Potential Customer / Customer offers its express consent, within the limits of the legislation in force, to be contacted by third parties, HOT AUTO partners: marketing service providers, transportation service providers, payment service providers, other service providers; state, governmental or insurance agents, when specific legislation so provides; other companies with which HOT AUTO may develop joint programs to offer products within the markets of the European Union.
HOT AUTO newsletters and SMS are sent through specialized partners approved by HOT AUTO, thus ensuring the confidentiality and security of information.
The customer who creates an Account on the HOT AUTO website / online store has the possibility to express his agreement regarding the receipt of Newsletters. The option regarding the agreement issued by the Client can be modified at any time by contacting HOT AUTO or using the Unsubscribe option.
The waiver of the receipt of the Newsletters by the Potential Customer / Customer can be done at any time using the specially dedicated link within any Newsletter or by calling the phone number of HOT AUTO.
Waiver of receipt of future Newsletters does not imply a waiver of acceptance of this "Terms and Conditions" document.
• In order to profile, monitor, and send personalized communications and offers, we may use third-party service providers.
• These activities have no legal effect or another similar significant effect on users. The only consequence of using this profiling is for users to receive discounts and personalized marketing offers. The user can choose not to be profiled or to receive commercial communications, without any effect, other than to receive these discounts or personalized marketing offers.
• For the purpose of processing, monitoring activities (profiling) and interaction with the site, Retargeting.biz must automatically collect and store the following personal data: e-mail, phone number, name, surname, sex, date of birth, city, county IP address (including possible location), browser, order ID, discount code, discount value, shipping cost, total order value, the individual price of ordered products, product variations, products, device, OS, IP location, timestamps related to page visit, page visit, category visit, brand visit, click on the picture, mouse over cart, mouse over price, scroll up, scroll down, add to cart, remove from cart, select variation, add to Wishlist, comment, Like on Facebook, visit the help page.

The prices of the Products and Services displayed on the online store of HOT AUTO - the site www.hotauto.eu include VAT according to the legislation in force. During Checkout it will be displayed the price without VAT and the value with VAT.
The price, the payment method, and the payment term are specified in each Order. The Seller will issue to the Customer an invoice for the delivered Products, the Customer having the obligation being to provide all the information necessary to issue the invoice, according to the legislation in force.
The Seller will send to the Customer the invoice related to the Order containing Products sold by HOT AUTO, to the e-mail address mentioned by the Customer in his Account, and/or contact information fulfilled by the Customer upon order placement.
The Customer has the obligation to update whenever necessary the data from his Account and to access the information and documents related to each Order, existing in the Account, in general for efficient communication and especially for the correct communication of the invoice related to the launched Order. by Customer.
HOT AUTO provides this method of communication that will allow the Customer, accessing his account, to have a historic record on order made.
The Customer - by making the Order - agrees to receive the invoices in electronic format issued by HOT AUTO in the Account or by Email address mentioned in his Account.

Payment for the Products purchased from HOT AUTO Online store–www.hotauto.eu can be made as follows:
a. online by debit or credit card:
-The card must be valid and have sufficient money.
- HOT AUTO does not apply any additional commission for this type of payment.
- Payment processing will be done for bank cards issued in the EU (cards issued under the Visa, Visa Electron, MasterCard, Maestro, etc.)
- For to make the online payment you must fill in the bank card data in the payment form
- HOT AUTO has no access to any card data of the Customer.
- The transactions are provided by the electronic payment service: Stripe.com - Stripe, 510 Townsend Street, San Francisco, CA 94103. To review the Privacy & Terms of Stripe, please click the following link: https://stripe.com/en-ro/privacy
- Any bank cardholder has the possibility to define the personal password that will confirm his/her identity and protect the card data against fraudulent use on the Internet.
- After making the payment you will receive a confirmation e-mail.
b. on delivery:
- If you choose to pay in “cash upon delivery”, you will pay the value of the order directly to the courier who will deliver the products and together with the receipt that is proof of payment.
- Currently, the Cash upon delivery is available for certain markets - Bulgaria and Hungary. HOT AUTO might consider the possibility to extend the “cash upon delivery” option within the other countries of the European Union.
- HOT AUTO does not apply any additional commission for this type of payment(s).
- The courier will issue a receipt identical to the tax invoice that can be found on the package.
c. by payment order:
- You have the possibility to choose the option "Bank transfer (delivery after transaction confirmation)"
- You will receive the proforma invoice after order confirmation by HOT AUTO team member.
- HOT AUTO does not apply any additional commission for this type of payment.
- You can pay by payment order inside EU and SEPA in EURO in the account - Account holder: HOT AUTO SRL, Wise Business, Avenue Louise 54, Room S52, Brussels, 1050, Belgium. IBAN: BE74 9670 3085 9807, BIC TRWIBEB1XXX.

The Seller undertakes to deliver the Products according to the Customer's option, to the address specified by him/her.
The Seller will ensure the proper packaging of the Products and will ensure the transmission of the accompanying documents.
The Seller will deliver the Products only within the European Union countries.
All Products sold by HOT AUTO (except for resealed Products) benefit from warranty conditions in accordance with the legislation in force and the commercial policies of the producers. The products are new (except for resealed products), in the original packaging by manufacturer HOT AUTO.
In the case of Products sold and delivered by HOT AUTO, the warranty certificates are issued directly by the manufacturer HOT AUTO.
The lack of the Product warranty certificate must be reported within a maximum of 3 (three) working days from the receipt of the goods at info@hotauto.eu, any subsequent notification outside this period will not be taken into account.
In the case of resealed Products, the warranty certificate will be issued by HOT AUTO, the warranty may cover a different period than the warranty period of the same new, sealed Product. The warranty period is specified in the warranty certificate for each resealed Product separately.
The conditions of use, handling, and transportation of a resealed Product are the same as those of new sealed products and benefit from the same services unless otherwise stated on the product page.
TRANSFER OF OWNERSHIP OF PRODUCTS
Ownership of the Products will be transferred upon delivery, after payment by the Customer, in the location indicated in the Order (delivery will mean the receipt of the transport document provided by the courier company).
Seller shall not be liable for damages of any kind that Potential Customer / User / Customer or any third party may suffer as a result of the Seller's fulfillment of any of its obligations under the Order and for damages resulting from the use of the Products after delivery, and especially for their loss.
The Client / User / Customer assumes responsibility by creating and using the Account, for maintaining the confidentiality of his Account data (user and password), and for managing access to the Account, being responsible for the activity carried out through his/her Account.
The Potential Customer / User / Customer - by creating the Account and/or using the Content and/or placing the Orders - expressly and unequivocally accepts the General Terms and Conditions of the HOT AUTO online site, in the updated version and communicated on the site www.hotauto.eu, existing on the date of creating the Account and/or using the Content and/or on the date of placing the Order.
After the creation of the Account, the use of the Content implies the acceptance of the changes made to the "General Terms and Conditions" and/or the updated versions of the General Terms and Conditions of the HOT AUTO online site.
The "General Terms and Conditions" of the HOT AUTO website may be modified at any time by the owner, these being opposable to Customers / Users / Customers as soon as they have been displayed on the site. Acceptance of the "General Terms and Conditions" will be confirmed by checking the appropriate page on the site and/or by sending the Order and/or by making an online payment.
Comments/Reviews can be registered by Users / Potential Customers / Customers, in the "Comments" section. The information entered can be both positive and negative, and will refer to the characteristics and/or the way of using a product and/or service.
By registering a Comment/Review on the HOT AUTO Online store website, you agree to the "General Terms and Conditions".
Statistics classify a Comment as "ideal" if the impressions of the Products are made in words that are easy to understand by other Users / Potential Customers / Customers and contain between 50 and 300 words.
Each User / Potential Customer / Customer, when registering Comments in the mentioned section, undertakes to comply with the following rules:
- the references made in the Comment to refer only to the characteristics and/or the use of a certain product, avoiding information related to aspects that can be changed (price or promotional offers) or information related to the order;
- to use only the English language. Words or expressions that, although not considered English, are widely used in all media related to the respective field are also allowed;
- to use an appropriate, non-offensive comment/review, without terms that may offend or affect any other User / Potential Customer / Customer;
- to ensure that the information entered by them is realistic, correct, not misleading, and in accordance with applicable laws, thus respecting the rights of other parties, copyright, trademark, license or other property rights, advertising or privacy;
- not to provide or request, in any way and to any extent, personal data (contact details, information about the delivery or domicile address, telephone numbers, e-mail addresses, name and/or surname, etc.) or any other information that may lead to the disclosure of such personal data;
- not to register information and/or details about links (links) from/to other commercial sites that carry out the same or similar commercial activity as the Seller;
- not to submit Comments/Reviews containing advertising materials;
- not to use the Comment/Reviews as a means of communication with the Seller, in this sense the contact data of the Seller registered on the Site will be used.
If a Comment is reported by a User / Potential Customer / Customer as having inappropriate content, this content is carefully examined by the Seller - as it is a subjective opinion - to determine whether it in any way violates the Terms and Conditions in General.
If the Seller finds a violation of the General Terms and Conditions repeatedly, it reserves the right to suspend the possibility of the User / Potential Customer / Customer to submit Comments.
For notifications or complaints related to the Product and/or Service purchased, the Customers have at their disposal the e-mail address and telephone numbers of the Seller. The maximum term for resolving complaints or notifications is 30 calendar days from their receipt.
According to the requirements of Law no. 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data, amended and supplemented, HOT AUTO has the obligation to manage in safe conditions and only for the specified purposes, the personal data you provide to us.
The purpose of data collection is: informing Users / Potential Customers / Customers about the status of their Account, informing Customers about the evolution and status of Orders, evaluation of Products offered, commercial activity, promotion of Products, marketing, advertising, media, administrative, development, market research, statistics, tracking and monitoring of sales and the behavior of the User / Potential Customer / Customer.
Once completing the data in the account creation and/or Order form, the Customer declares and unconditionally accepts that his/her personal data will be included in the HOT AUTO database, registered in the General Register of the National Authority for Data Processing Supervision. Personal Character, and expressly and unequivocally agrees that all such personal data be stored, used, and processed indefinitely territorially and/or temporarily by HOT AUTO or their collaborators for carrying out and/or carrying out activities such as - but without is limited to - commercial activities, promotion of products, marketing, advertising, media, administrative, development, market research, statistics, tracking and monitoring of sales and consumer behavior. By reading the document "General Terms and Conditions" you have learned that you are guaranteed the rights provided by law, namely the right to information, the right to access data, the right to intervene, the right to oppose, the right not to be subject to a decision individual, the right to go to court in case of violation of the rights guaranteed by Law 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data.

Based on a written request, dated, signed, and sent to: HOT AUTO SRL, Str. Durau No. 118, 8, 12916, Sector 1, Bucharest, Romania you can exercise your right to intervene on the data, as appropriate:
a. Rectification, updating, blocking, or deletion of data whose processing is not in accordance with law 677/2001 for the protection of individuals with regard to the processing of personal data and free movement of such data, in particular, incomplete or inaccurate data;
b. the transformation into anonymous data of the data whose processing is not in accordance with law 677/2001 for the protection of persons regarding the processing of personal data and the free circulation of these data;
c. the notification to third parties to whom the data have been disclosed, if this notification does not prove impossible or does not involve a disproportionate effort towards the legitimate interest that could be harmed.
HOT AUTO may provide the Customer's personal data to other companies with which it is in collaboration, but only on the basis of a confidentiality commitment on their part, which guarantees that this data is kept secure and that the provision of this personal information is made according to the legislation in force, as follows: providers of marketing services, courier, payment/banking services, telemarketing or other services, provided by companies with which we can develop joint programs for offering products on the market.
The Customer's personal information may also be provided to the General Prosecutor's Office, the Police, the courts, and other competent state authorities, based on and within the limits of the legal provisions and as a result of expressly formulated requests.
Neither party will be liable for non-performance of its contractual obligations if such failure to perform on time and/or properly, in whole or in part, is due to a force majeure event. Force majeure is an unpredictable event, beyond the control of the parties and which cannot be avoided.
If within 15 (fifteen) days from the date of its occurrence, the event does not cease, each party will have the right to notify the other party of the full termination of the Contract without any of them being able to claim damages from the other.
This Agreement is subject to Romanian law.
Any disputes between HOT AUTO SRL and Potential Customers / Customers will be settled amicably or, if this is not possible, the disputes will be resolved by the competent Romanian courts in Bucharest city, Romania.
